"The government admitted to waterboarding Mr. al-Nashiri and will be basing its prosecution on evidence obtained through torture," said Nancy Hollander of the John Adams Project, a joint effort of the National Association of Criminal Defense Lawyers and the American Civil Liberties Union.
"It will use this information in a military commission proceeding that provides none of the safeguards that protect from an unjust conviction. These procedures -- and the torture committed by our government -- clearly violate both U.S. law and the moral standards that are the foundation of our country."
The problem when you torture people for information is that evidence obtained by torture may not be admissible in court. Then what does the government have to convict?

Well the government found him and caught him for a reason. There are other circumstances involved in every case that are more than what the accused has said. Who were his friends? Where was he caught? WHat criminal record does he have prior to this trial?
Anyone know what the AMERICAN Civil Libery Union is doing trying to defend a person from a different country, especially one with ties to terrorism? I love the new America. We protect everyone excpet Americans.

Well if you use the right techniques you can get people to say anything.
But of course there are those who would deny that. I haven't met anyone yet who can withstand torture without giving information. The information may be a lie. But it stops the torture.
Don't believe it. Ask someone who has been tortured, ask them under hypnosis or under truth serum.
There is no doubt that if this al-Nashiri was involved he deserves to die, and he will of that I have no doubt.
But when our servicemen and women are captured and tortured then put to death for the lies they will tell to stop the torture.
The ones favoring torture have no right to decry the injustice. For it is by your agreement that torture is an acceptable means of gaining evidence.
So who are the terrorists again? Any who torture to prove the guilt of another.

I think the terrorist are those that fight out of uniform using innocent people as human shields and deliberately targeting civilians.
They dont deserve anything but a bullet to the back of their head when they are caught.

No one wants to protect the terrorist. We want to protect our freedom. If you can just grab this guy, torture a confession out of him, then execute him with no other evidence than why can't they do that to you or me? Because we are citizens? Don't count on it. Those who don't learn from history are doomed to repeat it. This type of thing has happened many times and in many places before. It's one of the reasons that our constitution was put together the way it was. If you let them circumnavigate the constitution it won't be long before they will be knocking down doors here at home and dragging people off in the night.

Pathetic. Some of the comments on this page reminds me of the lynch mobs of the old west. It doesn't matter if the man is really guilty. Just as long as you have someone to hang so you feel that you have accomplished something.
I feel for the sailors that died in the USS Cole bombing and their families but I bet that every member of every family would want to be sure that they have the right man so the guilty one doesn't walk free. These comments are really pathetic.
