News – Willie Campbell of Dallas, Texas was sentenced to 35 years in prison this Wednesday for spitting at the police officer in 2006. Discrimination? I think so.

And since we are talking about spreading of HIV virus no i dont think it's ok as baddad59 stated..there is no chanse anyone can get aids or become HIV positive from a contact with saliva of the infecter person. There is a whole study on saliva and HIV virus. If you are interested i can dig out a couple of links i used since i wrote about this in my final paper in med school :)
He was sentenced for a crime that he may, or may not have committed. But, he did spit into a police officer's face. He deserves some form of punishment for not respecting the law. 35 years seems kinda harsh, until you realize that the police officer must live with the fear of possibly having HIV/AIDS. he will live with that fear for a long time.

The last time I checked, citizens are supposed to respect the police officers too. So here we have two people checking on what others are supposed to and not supposed to do. Had the idiot not been too drunk, there would not have been a problem. He caused his own grief.
your arguemtns arent valid. the law and the courts dont concern themselfs with what may or may not happen. they are supposedly only be concerned with solid facts. that hey may get HIV from spit is irrelevant. and he couldnt, zero chance. That is relevant. the spitter may or may not have wanted to infect him, its unprovable. so its irrelevant. the officer didnt get HIV and thats relevant but anymore in the united states, people are getting sent to prison for stupid reasons on the whims of officers based on opinion, not facts. Our nation is becoming a police state.
On the flip side, people wearing US military uniform and who have committed rape, murder and arson in Baghdad are given a slap on the wrist and sent home.

Nikka's comment had ZERO to do with discrimination, was merely an attack on US policy (and how it's faults are dealt with, in his/her opinion). THAT belongs on a different thread, not this one (IMHO).....
Not sure I'd term this discrimination, more like a fearful reaction to a nasty situation. Whilst I do NOT condone the spitting and general "kicking up" the defendant was doing, the sentence strikes me as way to severe for the actual crime.....
Did the prosecution "prove beyond reasonable doubt" that the defendant beleived he was using a "loaded weapon - HIV virus" ? Wasn't mentioned in the article.... If not, he should walk...... OK, and be retried for being an obnoxious POS, but 35 years for what he actually did ????

I lived in San Francisco in the early 80's when AIDS broke out. They didn't even have a name for it then.
Public health officials said that the virus was ONLY transmitted via homosex. ONLY. If you thought otherwise, you were labeled paranoid.
Well, it was discovered that AIDS could be transmitted via blood transfusions, open cuts, tears, heterosex, congenitally, and on and on.
I would like to see any of the posters here volunteer to get spit on by an HIV positive person just to you know, prove their points. Any takers? I didn't think so.
Just another excuse to further stain our already overburdened prison population.

Interesting that the poster didn't mention that Campbell is HIV positive, and this is considered assault with a deadly weapon... and rightly so.
Perhaps the poster thinks that is ok to try to spread HIV,after all campbell probably didn't know what he was doing..right.
Maybe you should read the article before commenting. It's plainly stated that there is no chance of infecting anyone with saliva. Better yet read the part on HIV and chances of becoming infected in "The Journal of Oral Pathology & Medicine."
Correction. It was stated that it has never known to happen. That is different from no chance. How many people have been spit in the eye by an AIDS carrier?
You have to prove something will happen to say it will happen. Spit is not a proven risk, by anyone. The 'what if' game doesn't fly with the law. This sentence needs to be overturned. The hysteria over HIV did enough to people in the past. We sure as hell don't need to go there again.
Spitting on someone is not a felony (at least not here in NY)...a mean thing to do, yes, but I'm sure many police officers have been spat at by drunks.
I hope they appeal the case...sounds pretty iffy to me, especially since saliva itself can't spread HIV.
Now, in just reading of the case of the man who was released from a Texas prison after spending 30 some years in jail for a crime he didn't commit, I really think they should take this guy's spit and get a DNA sample.
Quite possibly another person spat at the officer, and we wouldn't want someone to go to jail for the spit crime if they didn't do it.
Better to be spit upon than to have been close to the Clintons.

To me Ghost,and to a lot of other people,saliva is a bodily fluid and i don't want to be exposed period.I wouldn't want anyone i know exposed in that manner either.It has been our ignorance that has mane aids the epidemic it is.
I wouldn't appreciate being spit on either, but it doesn't negate the fact that the spit of an HIV person isn't going to give you the virus. And it wasn't ignorance that gave the U.S this serious problem. It was prejudice.

First of all, HIV and AIDS aren't the same thing. HIV is a virus that affects the immune system, breaking it down. AIDS is the cluster of diseases that result from that breakdown. You can have the virus (HIV), and not have AIDS. SO...you don't get AIDS spit on you. It's HIV that you need to concern yourself with.
Again, you don't contract HIV from saliva, so if it did land on a sore, you won't contract HIV. If there is blood in the saliva, then you'd be concerned.

No, not 'rightly so.' Saliva doesn't have the requisite HIV antibodies to cause infection. Blood, mothers milk, semen, and vaginal fluids are the bodily fluids that do. Hopefully, this will be overturned by the courts. The man's spit posed no risk to anyone.
What if the guy had a bloody lip or a cut in his mouth from the scuffle with the police?
Actually you need to have more blood than saliva in your mouth when spitting at someone in order to infect them, and even then it's not proven that the infection is possible. So unless he spat blood at the police officer this case it a total BS :p
This happened about two years ago so by now the police officer had at least 2-3 tests. (Most people develop detectable HIV antibodies within 6 to 12 weeks of infection. In very rare cases, it can take up to 6. It is exceedingly unlikely that someone would take longer than 6 months but still they had enough time to check it).
Becides if they found any open wounds in his mouth it'll be all over the news a long time ago. And how the heck did they figure out that he actually ment to infect the police officer.
What if doesn't cut it. The facts state he spit. Period.
